      • You find five or six that you are interested in and try and set up appointments to see them.  Good luck trying to coordinate that if  you can even get hold of the each agent.
      • The internet is not going to prepare you for what you are going to need in order to purchase your dream home.  It is not going to ask you to talk to a lender before you start your search which will save you a lot of heartache.  Finding a home you love but for which you will not qualify is going to hurt.
      • There is so much involved in buying a Los Angeles home, and using the services of a Los Angeles buyer's agent is not going to cost you a penny and will probably save you a lot.  They are going to take care of your best interests in getting the best price and terms and also guide you through the complicated purchase process.  And complicated it is.

Renting a Los Angeles Home

Right now the Los Angeles rental market is extremely hot.  When something good comes on the market it is gone immediately.  You can search sites like Westside Rentals for which there is a fee or Craigslist, which is free and has most of the same listings as Westside Rentals, but also is known for the scams conducted there.  So you have to be careful.  You can, of course, drive around and look at For Rent Signs.  Very time consuming.

The MLS does not have as much of a choice but using a real estate agent to set up appointments and narrow your search down is going to make your life so much easier.

How Should you Handle the Request for Repairs - With Care

When buying a Los Angeles home be prepared to put on your negotiating hat.Repairs

When you are caught up in the emotion of buying a home you may forget that there is another side to the process, the Seller.  Generally each side is trying to get the best deal for his or herself and is not always considering the other party.   Arriving at an agreed upon sales price is only part of the process, equally important is what comes next.  Even though a home is listed with the caveat “as is”, that really does not mean much.  Almost every Seller expects that they are going to receive a request for repairs.

The Request for Repairs

In Los Angeles it is required that a buyer conduct a home inspection or waive their right to one.  The standard time allotted for the buyer to do his or her due diligence is 17 days.  As a good faith tactic during contract negotiations this is often lowered to 10 days and sometimes even 7 days.  This is generally enough time to have your inspector come out to the property and also to order any additional inspections that may be suggested.  Once these inspections have been completed and you have the report(s) in hand, you will sit down and discuss your request for repairs  with your real estate agent.  And once the request is submitted the clock stops and the ball is in the Seller’s court.

You are now back to your previous position of possibly where you should consider that there is another side to this transaction.  The Seller.  Get your negotiating cap back out and think about the following:

What should you ask for?

When you look at your home inspector’s report you are going to see so many items for repair noted that your head will spin and you might think the house is about to fall down.  But understand that many of them are a symptom of the age of the house and are normal wear and tear, and may not be items for major concern.  The most common I see are:

  1. Electrical panels needing upgrade
  2. Electrical outlets not up to code
  3. Plumbing leaks
  4. Dripping toilets and faucets
  5. Cracks in walls
These are generally minor items that are probably not going to cost much to repair. And remember the previous owner has been living with them for awhile.
Major items of concern might be:
  1. Foundation cracks or lack of bolting
  2. Cracks in the chimney
  3. Wear showing on the roof
  4. HVAC that may need replacing
These items can be expensive to repair or replace.

Did you offer full price?

If you did then asking for all the items of major concern to be replaced may be the place to start.  You may get a positive answer to all or most of them.

Did you get the house for a little less than asking?

You might want to leave an item or two out of your request for repairs.  Asking for everything might get you a no on all.  Asking for selective repairs might get you all of them, but you should at least get some.

Did you pay significantly less than asking?

If so, you are probably not going to get much in the way of repairs.  Remember, the Seller is already losing and is not likely to give up more money.  So, when you do get the home for a good price be of the mindset that this probably will not come with repairs.  Think of it as having negotiated your repairs up front.

I know homes have fallen out of escrow over the request for repairs not being agreed to by the Seller, but if both parties can put themselves in the other side’s shoes, there can be a successful outcome.  Again, it is all about the negotiations.

Carbon Monoxide Detectors Now Mandatory for Los Angeles Home Sellers

Just so that everyone has a clear understanding – California Senate Bill 183 was signed into law to regulate the Carbon Monoxide Detectorsinstallation of carbon monoxide detectors. The law is a two-part law that requires an update to the Transfer Disclosure Statements used in a real estate transaction, and puts into law the Carbon Monoxide Poisoning Prevention Act of 2010.

The first part of the new law requires that as of July 1, 2011, Transfer Disclosure Statements (TDS forms) include a line item regarding the presence or absence of a carbon monoxide detector in the same manner as Smoke Detectors, for all residential units that are sold. This applies to just about all types of occupancies from single family owner-occupied and rentals, to multi-family housing. If the property is being sold, it must now include a CO Detector if the dwelling has gas appliances, fireplaces, and/or attached garages as described below.

The second part of the law enacts the Carbon Monoxide Poisoning Prevention Act of 2010 which requires that all residential properties, not just those being sold, be equipped with a carbon monoxide detector when the property has a fossil fuel burning heater or appliance, fireplace, and/or an attached garage.  All single-family homes in structures with 1-4 units (owner or tenant occupied) must be equipped with a detector on or before July 1, 2011.

All other multi-family residential units must be equipped with a detector on or before January 1, 2013, not just those being sold.

For rentals, the carbon monoxide detector must be operable at the time the tenant takes possession. A tenant is responsible for notifying the owner or owner’s agent if the tenant becomes aware of an inoperable or deficient carbon monoxide detector within his or her unit. The owner or owner’s agent must correct any reported deficiencies in the carbon monoxide detector and will not be in violation of this section for a deficient or inoperable carbon monoxide detector when he or she has not received notice of the deficiency or inoperability.

The bottom line is that ALL SINGLE FAMILY residential dwelling units as of July 1, 2011 must have a CO detector, even those that are not being sold. All other dwelling units (multi-family, dormitories, hotels, motels, etc) must have CO detectors installed by January 1, 2013.

Expect to see this new inspection item in your home inspection report. Home inspectors will be required to report on the presence or absence of a working Carbon Monoxide detector just like they report on Smoke Detectors, and water heater strapping.

Home buyers and sellers will also see this new requirement on Transfer Disclosure Statements. In addition to smoke alarms and strapped water heaters, sellers will be required to disclose the presence or absence of a working carbon monoxide detector

Buying a Home in Los Angeles - Westwood - Century City

You are new to Los Angelesthinking of buying a home in Los Angeles, but have no idea where to start.

We could use West Los Angeles as an area, but this is such a loose term and there arguments as to what really constitutes West Los Angeles.  In my mind West Los Angeles is an area that stretches from Westwood south to Rancho Park and Palms, west to Beverly Hills, and east to Brentwood and Santa Monica,  and for the purposes of this post it will be included together with Century City,  a small area on the south-east side of West L.A.

Westwood 90024, is the home of UCLA and a mix of commercial and residential with multi million dollar homes and condos and apartment buildings, the latter prevalent near the campus.  Westwood Village boasts movie theaters, restaurants and shopping.  Westwood is a desirable area for students attending the college.

The Wilshire Corridor 90024, also known as The Golden Mile is an approximately 2-mile stretch of high rise, high-priced condo buildings perfect for those looking to downsize and live in pampered luxury.

Century City 90067, is a commercial and residential district which derives its name from 20th Century Fox and sits on the old back lot of the studios.  It is home to many entertainment, law firms and upscale condo buildings, both low and high rise,  including the new Century, and it is one of the few areas that offers some nice outdoor space in its complexes.

Want to be Successful in Buying a Los Angeles Home? Be Prepared to Negotiate

If you are serious about buying a Los Angeles home then don't listen to the friends who are telling you that there are deals to be made, and you should just make low ball offers until a seller rolls over and says "take my home."

It doesn't happen that way.

If you are serious about buying a Los Angeles home,  don't try and do it alone.  You are going to end up tremendously frustrated, and things will become way too personal.

If you are serious about buying a Los Angeles home,  use a real estate agent who will be your exclusive representative and keep you on the right track towards home ownership.

Above all, be prepared to negotiate.

The whole process of home buying  and, of course, home selling, is about give and take.  It is about reasonable people coming together to make things happen.  A seller wants to sell and a buyer wants to buy.

How do we bring the two sides together?  Each one has their own representative, the real estate agent.  When a couple get divorced they each hire a lawyer who "battle out" the terms.  I don't think there has ever been a case of one attorney representing both sides....

In the case of a real estate transaction each side should be represented by their own agent and each Los Angeles real estate agent will be responsible for getting the best deal for their client.  A perfect reason not to think that you are going to get what you want by using the same agent as the seller.  One agent cannot negotiate for both sides.

Each agent will inform their clients what a reasonable price is.  If the home is reasonably priced then the buyer needs to make a reasonable offer.  If a reasonable offer is presented, then the seller should entertain that offer, either by accepting it or negotiating with a counter.  If a counter is presented the buyer can either accept the terms of the counter or negotiate their own terms with a counter of their own.  Supervised by two go-betweens.

And if all goes well and the offer is accepted, any items of concern that are discovered during the escrow period can also be negotiated.

If you put yourself in your real estate agent's hands and trust their negotiating powers, you will end up buying the Los Angeles home  of your dreams.

Why Use a Real Estate Agent When Buying a Los Angeles Home

If you are selling a Los Angeles home,  you will be using just one real estate agent because you will sign an exclusive listing agreement with that agent which means, yes, that you work exclusively with that agent.  The work involved in selling a Los Angeles home warrants  that kind of loyalty, and you as a seller will be paying commission to that agent and the co-broker who brings the buyer.  Makes sense, right!

Now, if you are buying a Los Angeles home, or renting a Los Angeles home why would you not use an agent exclusively?  There is something called a Buyer Representation Agreement which some agents ask the buyer to sign before working with them, but since they are not really enforceable many of us work on trust.

Many Los Angeles home buyers and renters do not fully understand the role of the real estate agent in the transaction.

Who pays the realtor's fee?

An agent does not get paid until a deal is consummated, on the listing side or on the buying side.  And, as a buyer, you don't pay the agent, the seller or landlord does.

Why should I use one agent?  Won't I get more choice if I use several?

No.  Every agent has access to the same information - listings on the Multiple Listing Service (MLS).  This is the only place you are going to find an active listing.  In some cases an agent may have access to a pocket listing (a home that is not listed on the MLS), but this is extremely rare, almost like finding a needle in a haystack.

Won't I get a deal if I go directly through the listing agent?

I doubt it.  Dual agency (where an agent represents both sides) can be a slippery slope.  Although that agent is bound to represent both sides equally and fairly, remember who is paying the commission....   And, many brokerages don't allow dual agency.  Would you not rather be represented by someone who is 100% committed to getting you the best deal and terms possible?

And why would you want to constantly be searching the internet looking for properties.  You are not going to find anything that your agent won't know about if they are worth their salt, and since the only accurate representation of what is truly available is the MLS, you could be wasting your time, finding properties that are already off the market.  Never mind trying to get hold of ten different agents to set up appointments on ten different properties, half of whom don't call you back.

If you are buying a Los Angeles home,  or even renting, find an agent you trust and put yourself in their hands. You have no idea how much easier your life will become.
